Teen Sues Parents in Abortion Fight

A 16 year-old Texas teen is suing her parents to stop them from forcing her to have an abortion.

KTRK-TV is reporting that the teen, whose name has not been released, is two months pregnant and wants to keep her child; however, her parents are adamant that she is to abort the baby.

The girl sought help from attorneys at The Center for Defense of Life who filed suit on her behalf and are asking a judge to stop her parents from forcing her to have an abortion by coercing her with verbal and physical threats and harassment.

In the lawsuit, the teen claims her mom “…invited the paternal grandparents to a bar for further discussion, where she suggested that she might slip [the teen] an abortion pill through deception.”

She also claims that her parents have taken away her phone, forced her to get two jobs, kept her from school and took her car as punishment for failing to have the abortion. Her father also threatened to take her for the abortion, she claims, saying that “the decision was his, end of story.”

Joel Androphy, a legal analyst for KTRK, said the girl definitely has a case.

“Her parents cannot force her to have an abortion,” Androphy said. “If the parents force an abortion on a minor, the parents can not only be subject to civil responsibility, but they can also be criminally liable under our fetal homicide laws, because not only does the minor have a right to be protected, but the fetus does, even under Texas law.”

The girl’s father denied the allegations and told KTRK that he believes someone put his daughter up to the lawsuit filing.

Meanwhile, the teen is living with her paternal grandparents, who agreed to help care for the baby, the lawsuit claims.

In addition to preventing her parents from forcing her to have an abortion, the suit also seeks a temporary restraining order against the girl’s father for the duration of her pregnancy.
