LifeSiteNews.com is reporting on an interview with Tom Brejcha of the Thomas More Society, a public interest law firm that is representing Daleiden.
In the interview, Brejcha describes the latest legal volley by a seriously wounded abortion industry desperate to staunch the bleeding caused by undercover videos that exposed what could be the illegal trafficking of fetal body parts. He describes their new lawsuit as “a humongous case . . . involving 13 claims” that the CMP violated federal RICO laws and various provisions of California law. \
They want to stop the organization from releasing any more videos and are also seeking to force them to take down all existing footage from the internet. The suit is also aimed at preventing the CMP from working with law enforcement in their investigations.
"The National Abortion Federation (NAF) is seeking to suppress [CMP Lead Investigator] David [Daleiden]'s ability to communicate. It's an attempt to get a gag order," Brejcha said. “They want to put him in jail. They want to destroy him financially."
He went on to say that "they're really pursuing the case in a very nasty way," accusing CMP investigators of perpetrating a "crime spree."
However, as Brejcha explains, CMP in general and Daleiden in particular "broke no laws" and "consulted with experts before he began his 'Human Capital' project."
The new filing comes in the wake of a subpoena issued by Rep. Jason Chaffetz, R-UT, for the full, uncut footage gathered during the undercover sting as part of a Congressional investigation into the industry’s practices.
Brejcha says he has maintained a “furious pace” of court filings and responses in what has become an outright war with the abortion industry.
"We've had probably the most intensive month of litigating I've ever undergone in my 45 years of practicing law, and that includes the [Joe] Scheidler case, [which lasted for 28 years]" Brejcha says. "This is just as big or bigger than that."
"We're up against a massive corporate law firm," he says. "The Obama administration, the Justice Department is waiting to pounce."
In other words, the abortion industry has called upon all of its allies in government to help them get out of the mess they’re in.
According to a statement issued last evening from the Life Legal Defense Foundation (LLDF), the Ninth Circuit Court of Appeals has stayed discovery and ordered attorneys for the National Abortion Federation to respond to questions of importance raised in a petition for mandamus. NAF’s attorneys have until today, September 18, to file a response.
The federal trial court will consider whether the restraining order it issued last month prohibits Daleiden from revealing his findings to law enforcement.
The discovery issues turn on whether NAF is entitled to obtain documents, recordings, and testimony from CMP and its investigators, or whether, as CMP and Daleiden contend, the lawsuit is a SLAPP action in which discovery is prohibited.
“SLAPP” stands for Strategic Lawsuit against Public Participation, the LLDF explains. The use of SLAPP suits against citizens voicing views opposed by powerful corporations has become such a problem that many states, including California, have passed statutes curbing such actions.
The Ninth Circuit’s order indicates that the higher court takes very seriously the objections raised by the LLDF and its allies to Judge Orrick’s fast-track rulings in favor of the NAF.
“David Daleiden and the Center for Medical Progress are exercising their First Amendment rights in order to expose the unconscionable practices of Planned Parenthood and other abortionists,” said LLDF attorney Katie Short.
“Despite howls of derision from abortion apologists, CMP’s video evidence has proven very effective in showing the public what the abortion industry is really all about. If these weren’t such a threat to the status quo, Planned Parenthood allies such as the National Abortion Federation would not be pulling out all the stops to silence them."
We need to keep all the players in this macabre story in our prayers - the the lawyers representing the CMP can prevail in court, that the judges will put aside any bias and rule fairly, and that those who are involved in, and are defending, the selling of fetal body parts obtained through abortion will repent and cease these immoral activities.
