Doctors Group Sues ObamaCare

By Susan Brinkmann, OCDS Staff Journalist A nationwide doctors group has become the first U.S. medical association to file a lawsuit against ObamaCare, which it says violates the Fifth and Tenth Amendments, the Commerce Clause and provisions authorizing taxation. LifeNews.com is reporting that the Association of American Physicians and Surgeons (AAPS) filed suit in federal court on Friday against the Patient Protection and Affordable Care Act (PPACA). Among the suits many charges are claims that requiring Americans to buy government-approved insurance or face  penalties violates Fifth Amendment protections against the government forcing one person to pay cash to another. The suit also contends that the PPACA violates the Tenth Amendment, the Commerce Clause, and the provisions authorizing taxation. "If the PPACA goes unchallenged, then it spells the end of freedom in medicine as we know it," said Jane Orient, M.D., the director of AAPS, in a statement. "Courts should not allow this massive intrusion into the practice of medicine and the rights of patients." She added: "There will be a dire shortage of physicians if the PPACA becomes effective and is not overturned by the courts.” The AAPS asserts that this court action is necessary "to preserve individual liberty" and "to prevent PPACA from bankrupting the United States generally and Medicare and Social Security specifically," it says. In spite of orchestrated media events where large numbers of white-coated doctors appear to be supporting the President’s plan, polls show doctors are not in favor of ObamaCare. A survey published in the New England Journal of Medicine found that almost 68 percent of physicians feel health care reform is needed, but should be implemented in a more targeted and gradual way rather than through the current plan.
